depending on your isp, some will just cance your broadband connection if their are a few acuations that you are d/l these items. (do not go to court)

No ! the act of downloading isn't illegal via P2P or any other method. The illegal part is when the movie or song you download is copyrighted. And that's the case 99.99999% of the time.

I've seen some home movies you can download that are not copyrighted so nothing illegal there. Just not much fun watching someone else's 21st birthday party or similar.

Seriously.
Advertising that you are GOING to be downloading illegal content and what ISP you WILL be on - is not the way to go about securing your connection with a particular ISP.

okay here is an example comparison of downloading movies using p2p and driving your car:

if you download 1 movie - equivalent to changing lanes without indicating

a couple of movies a week - like going through a redlight you might get caught and the consequences are about the same

up to 5-10 movies/tv shows a week - like speeding - doing 130km/h in a 100km zone.

more than 10 movies/shows/programs a week - driving without a seatbelt and going through redlights.

more than 20 and giving copies to your friends - speeding 30km/h over the limit whilst drunk.

more than 20-50 and selling copies at markets etc. - hit and run - if caught you'll go to prison.

the only difference in my analogies is that if you do some of those things in your car you are risking your life.

anyone care to expand or offer their version?

if they receive three emails saying your IP address has been downloading illegal files, they will terminate your connectection, leaving you with any fees for early contract cancellation.

I have not see any information about files here in Australia, but the US ones appear to be in the few to several thousand.

given the exchange rate, that is about 3,000 to 10,000 Australian.

You can download stuff that is not copyright or available for free distribution. Normally this doesn't include the latest movies and things like that.

Bittorrent clients always report to the tracker and with public trackers anyone can request a list of users (seeders and leechers) from the tracker. Normally your computer will then use that list to contact others in order to download the content you are after.

The authorities can also use this list to see who is downloading and sharing that file.

If they have your IP address they can contact the ISP and request your details or sometimes just get your ISP to forward the letter to you.

It is copyright, that means it cannot be copied without the copyright holders permission.

It doesn't matter what language it is in or what it is, it is still violating their copyright and they then have the right to sue you.

With copyright infringements it is up to the copyright owner to sue you for damages. The police and government doesn't normally get involved.

It should be noted, that downloading copyrighted material is illegal. So is selling material you are not authorised to sell.

EDIT:
Sure - you can do it if you want.
Just make sure you google around for information on using P2P before you start. So you are aware of what you should/shouldn't do and so forth.

No, it is NOT illegal to download them. But it is illegal to watch or listen to them.

US laws do not apply here. Fines are different over here than it is in the states. If you download movies and your ISP is told about it, chances are they will do nothing about it. However, if it happens continuously, your account will be suspended, not cancelled (Otherwise, I'd download shitloads of movies to get my bigpond contract cancelled)

If you're looking at doing what we're not supposed to, then we can't really comment much - as we'll be muted (WP has to protect itself, only fair). People in power have said almost word for word "we're not interested in charging people, we're after the ISP".

It's all "what-if's"... And a choice that each person has to make for themselves.

The number of people doing it would shock the pants of you - but so would the number things you do in everyday life already, when you realise it's not legal either.

What will happen?

IF you were singled-out of the millions of people doing it, and IF it went past a first/final warning you MIGHT get, then you could either A: Get kicked from your ISP (often with the option to churn/leave within a short period of time, like 1week). B: Be reported to the powers-above (who MIGHT look into your actions) C: Your ISP is already monitored by the men in black, and everyone's gonna get looked-into...

Bottom-line:
What's really gonna happen - Nowt.

People will scoff at that answer, but won't be able to show a real factor of how many people finish-up in the sh*t.

Having the opportunity to see it from both sides of the fence, and knowing how miserable the scare-tactics really are - you'll see that it's a impossible fight.

Is the whole scene wrong - No.
Do many take what they shouldn't - Yes.
Is it a hard crime - No.
Will you ever be punished - 1 in 10,000,000 chance of Community Service

I don't promote illegal acts at all, but I don't like BS either. FFS, tell it how it is /c:

language does not matter, may still eb copyrighted.

the other size of this is that copyright is normally only relivant in one country / similar language speaking countries.

their are some shops from japan that are copyrighted but the producers allow it to be spread to other countries besides japan and do not enforce the copyright issues until the US or other english speaking country pays for the rights to broad cast the show. once those broadcast rights are paid for, then the company start to enforce their copyright on people.

By definition, the creator of the work has copyright over it. The owner can licence various conditions to other parties but can never truly transfer copyright.

Though it's sick, the photographer of the kiddie porn is the copyright owner.

You're mixing things up here.

It's perfectly legal to download copyrighted freeware/shareware or trial software. The use of such software is governed by the software license agreement.

The same applies to movie & song demos as well as free independant releases. The license is the key that determines how one can use the copyrighted content.

Yes, in this case you have the permission of the copyright holder. The software license agreement or distribution rights specify what is allowed and what isn't. This is the copyright holder giving you permission.

Just on this, the police will usually be involved to the extent that an ISP will not release your details to a third party unless as part of a police investigation or otherwise subpoenaed.

In other words, the RIAA won't get your details by asking Exetel who was using a particular IP address at a particular time. If Exetel released those details on that basis my understanding is they would be in breach of privacy legislation.

well.. you will get fined a lot of money and go to jail. but sometimes, if you're lucky the p2p program (ie. limewire, kazza ect.) might get in trouble instead, depending of stuff such as no proof of you downloading illegal stuff.
